Terms of Service

1. Agreement
By creating a Tovira account or using the Tovira service, you agree to these Terms of Service. If you do not agree, do not use Tovira. These Terms form a legal contract between you and Prospera Technologies FZ-LLC, registered in the UAE.
2. Who can use Tovira
Tovira is intended for licensed real estate professionals operating in the United Arab Emirates. You must be at least 18 years old and have the legal authority to enter contracts on behalf of yourself or your brokerage. We may verify your identity or business registration before activating paid features.
3. Your account
- You are responsible for keeping your account credentials secure.
- You are responsible for all activity that happens under your account.
- You may not share your account with others.
- You must notify us immediately if you suspect unauthorized access.
4. Acceptable use
You may not use Tovira to:
- Send unsolicited messages or spam
- Engage in fraudulent or deceptive practices
- Violate anyone’s privacy or data protection rights
- Reverse-engineer, decompile, or attempt to extract source code from the service
- Build a competing product using Tovira’s outputs
- Violate Meta’s WhatsApp Business Platform terms
- Violate any applicable UAE law
5. Payments and subscriptions
Tovira subscriptions are billed monthly in AED via Stripe. You can cancel at any time; cancellation takes effect at the end of the current billing period. Refunds are not provided for partial months. Failed payments may result in suspension of service after 7 days of non-payment, and account closure after 30 days.
6. Your data
You retain all rights to the lead and conversation data you put into Tovira. We process this data only to provide the service to you, as described in our Privacy Policy. We do not train AI models on your data. We do not sell your data.
7. Tovira’s content and intellectual property
The Tovira name, logo, software, and design are the property of Prospera Technologies FZ-LLC. You receive a limited, non-exclusive license to use Tovira for your business purposes during your subscription. This license ends when your subscription ends.
8. Service availability
We aim for 99.5% monthly uptime but do not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice when possible. Tovira depends on third-party services (Meta WhatsApp, OpenAI for embeddings, Anthropic, Groq, Stripe, Resend, AWS) — outages or changes in those services may affect Tovira’s functionality.
9. Limitations of liability
Tovira is provided ‘as is’ without warranties of any kind. We are not liable for indirect, incidental, special, or consequential damages, or for lost profits, lost data, or business interruption. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.
10. Termination
You may cancel your account at any time. We may suspend or terminate your account if you violate these Terms, fail to pay, or use Tovira in a way that harms the service or other users. We will give you reasonable notice before termination except in serious cases (fraud, abuse, legal requirement).
11. Governing law
These Terms are governed by the laws of the United Arab Emirates. Disputes will be resolved in the courts of the UAE.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated via email at least 30 days before they take effect. Continued use of Tovira after changes take effect means you accept the new Terms.
